What happens if I get a traffic summons?

Ultimo aggiornamento 16 September 2026

If you receive a traffic summons (saman) while driving your rental car, you are responsible for it as the driver at the time. On top of the summons itself, Agtran applies a handling charge when a summons occurs: a service charge of RM20 plus a Tilang fee of RM10. These charges apply only if there is a traffic summons, there is no charge if you do not receive one.

A traffic summons, known locally as a saman, is a penalty issued for a traffic offence such as speeding or a parking violation. Because the rental car is registered to Agtran, a summons is sometimes sent to us and reaches you afterward. Here is how it works and what it costs.

Who Is Responsible for a Traffic Summons?

You are. As the driver at the time of the offence, you are responsible for any traffic summons issued during your rental period. This includes offences such as speeding, illegal parking, or other traffic violations. Summonses are issued to the registered vehicle, so even if the notice reaches Agtran first, the responsibility for the offence and its payment rests with the driver who had the car at that time.

What Are the Charges?

When a traffic summons occurs on your rental, the following handling charges apply, in addition to the summons amount itself:

  • Service charge: RM20
  • Tilang fee: RM10

These charges cover the administration of dealing with the summons. Importantly, they apply only if there is a traffic summons. If you do not receive a summons during your rental, there is no service charge and no Tilang fee. The summons amount itself is separate and is set by the authority that issued it.

When Do These Charges Apply?

The service charge and Tilang fee are triggered only by an actual traffic summons. To be clear:

  • No summons during your rental: no service charge, no Tilang fee
  • A summons is issued: the RM20 service charge and RM10 Tilang fee apply, in addition to the summons amount

So these are not standing fees on every rental. They only come into play if a traffic offence results in a summons.

What Happens If the Summons Reaches Agtran After I Return the Car?

Summonses do not always arrive immediately. Because they are issued to the registered vehicle, a summons for an offence during your rental may reach Agtran after you have already returned the car. If that happens, we will contact you to settle it, including the summons amount and the handling charges. This is why it is worth driving carefully and parking properly throughout your rental, so there are no surprises later.

How to Avoid a Traffic Summons

The simplest way to avoid these charges entirely is to avoid the summons in the first place. A few reminders:

  • Keep to the speed limits, which are enforced by cameras on many roads
  • Park only in proper, legal parking spaces, not on double lines or in restricted areas
  • Follow road signs and traffic rules, especially in unfamiliar areas
  • Pay attention to parking rules at malls, city centres, and tourist spots

Drive within the rules and no summons, and no handling charge, will arise.

How Will I Know and How Do I Pay?

If a summons is linked to your rental, Agtran will contact you using the details in your booking. We will let you know the summons amount and the applicable handling charges (the RM20 service charge and RM10 Tilang fee). Keep your booking confirmation and contact details up to date so we can reach you if a summons arrives after your return. If you have any questions about a summons linked to your rental, contact us with your booking reference.

In short

  • You are responsible for any traffic summons during your rental
  • If a summons occurs: RM20 service charge plus RM10 Tilang fee, in addition to the summons amount
  • No summons means no service charge and no Tilang fee
  • A summons may reach us after you return the car, and we will contact you to settle it
  • Drive within the rules to avoid a summons and its charges

Driving carefully and parking properly is the easiest way to avoid a summons and its charges. For more on the rules of the road during your rental, see our guide on what to know during your rental, or book your car online when you are ready.
