Terma & Syarat

• Drivers must be 20 years or older and hold a valid driving licence for 2 or more years. Additional fees apply for drivers under 20 or over 80.
• The driver's licence must be presented in person and be valid for the entire rental period.
• International drivers must present a valid International Driver's Permit together with their domestic licence.
• Only full licences are accepted. The renter must notify Customer Service of any endorsements before pickup. No refunds are given for undisclosed endorsements or for a missing licence at pickup.

• Only the named renter and any additional drivers registered and approved by Agtran before pickup may operate the vehicle.
• Each additional driver must meet the same licence and age requirements and be recorded on the rental agreement. An additional driver fee may apply.
• Allowing an unregistered or unauthorised person to drive the vehicle is a breach of these terms and may void any optional damage waiver.

• Every rental includes the statutory motor insurance required by Malaysian law. This basic cover does not remove the renter's responsibility for damage.
• The renter is responsible for damage to the vehicle up to the applicable excess amount, subject to the waiver terms below.

Damage waivers:

• Collision Damage Waiver (CDW), included: CDW is already included in your rental price at no additional cost. It reduces the renter's liability for accidental damage to the vehicle body to the applicable excess amount, subject to the exclusions below.
• Super Collision Damage Waiver (SCDW), optional: SCDW is an optional upgrade you can add at booking to further reduce the renter's liability below the standard CDW excess, subject to the exclusions below.

Waivers do not apply, and the renter remains fully liable, where damage results from any prohibited act (see Prohibited Acts), driving under the influence, an unauthorised driver, tyre or underbody or interior damage not covered by the waiver terms, or failure to file a police report where required.

Full waiver terms, covered items, and current excess amounts are set out in the rental agreement and the price list provided at booking.

• Rental rates are based on 24 hour periods starting at the time of pickup. Additional days are charged at the standard daily rate or higher. Early returns do not qualify for a refund.
• To extend the rental period, the renter must obtain authorisation from Agtran in advance of the original return date. Failure to obtain authorisation may result in additional charges.
• If the vehicle is returned after the agreed rental period ends, the renter will be charged an additional fee at the standard daily rate.

• The mileage allowance for your rental is shown on your rental agreement.
• Where a mileage limit applies, any excess distance is charged at the rate shown on the rental agreement.

In the event of an accident, theft, or significant damage, the renter must:

1. Ensure safety and contact the emergency services if anyone is injured.
2. Lodge a police report within 24 hours, as required under Malaysian law.
3. Notify Agtran Customer Service as soon as reasonably possible.
4. Not admit liability or arrange private repairs without Agtran's written consent.

The renter must provide the police report and any requested details to Agtran. Failure to lodge a police report where required may void any optional damage waiver.

The vehicle does not include roadside assistance unless separately arranged.

The renter agrees not to use the vehicle for any illegal or prohibited purpose, or any purpose deemed unsafe by Agtran. The renter must not:

• Drive while impaired by alcohol, drugs, or other substances.
• Transport illegal substances or contraband.
• Transport persons or property for hire.
• Tow or push any vehicle or trailer without authorisation.
• Drive on restricted roads, off road, or on unpaved surfaces.
• Overload the vehicle beyond capacity.
• Transport odorous items, smoke, flammable, hazardous, or explosive materials.
• Engage in intentional reckless driving or misconduct with the vehicle.
• Tamper with the registration or licence plate.
• Obtain insurance without Agtran's consent.
• Take the vehicle out of Malaysia or park illegally.
• Engage in activities causing inconvenience or damage.
• Carry a pet without permission.

Violating any prohibited act may result in immediate termination of the rental agreement and forfeiture of paid rental fees and deposits. The renter is responsible for all fines, fees, penalties, and damage resulting from prohibited acts.

A deposit is required for every rental as security against damage to the vehicle during the rental period and against any breach of these terms. Cash, debit, and credit cards are accepted. Agtran may decline the rental if the deposit requirements are not met. The deposit is collected before the vehicle is released and is refunded after return, less any amounts properly due.

• All rates are quoted in Malaysian Ringgit (RM) and are inclusive of Sales and Service Tax (SST) where applicable.
• The renter authorises Agtran to charge the payment method on file for rental charges, extensions, tolls, fines, damage, and any other amounts properly due under these terms.
• A standard administrative fee may apply per occurrence for processing third party charges such as tolls and traffic fines. The current fee is shown in our price list.

The renter can obtain a full refund if the reservation is cancelled 48 hours or more before the rental start.

No refunds are provided for:

• Cancellations within 48 hours without a valid reason.
• Downgrading vehicles within 48 hours.
• Failure to provide a registered driver or to collect the vehicle at the agreed time.
• Failure to present a valid licence or permit at pickup.
• Early returns during the minimum rental period.
• Unused rental days resulting from late pickup or early return.
• Changes in business or personal plans.
• No shows (failure to pick up the vehicle without notice).

Note: Some refunds may require supporting documents, subject to management approval. Refunds are processed within approximately 14 business days.

If the reserved vehicle is unavailable due to unforeseen circumstances, Agtran may provide a replacement vehicle of comparable or greater class at no additional cost. Agtran does not guarantee vehicle availability, make, model, or features. A refund will be issued if the replacement costs less than the reserved vehicle.

After hours pickups and drop offs are available by request for a fee per hour. The renter must arrange them at least 12 hours in advance. The renter remains responsible for the vehicle until the return is verified by staff. Failure to follow procedures may incur charges. Standard terms apply, and optional coverages may not be available.

Child seats, roof racks (not available on some vehicles), and other extras are available upon request in most locations but cannot be guaranteed. A fee typically applies. In most locations, child safety seats are required by law. Rear seatbelts may not be available in all vehicles. These items must be requested at the time of booking. Please contact Customer Service for details.

The vehicle is rented level to level. The renter agrees to return it with the same fuel level as at pickup. If the vehicle is returned with less fuel, the renter will be charged a refuelling fee based on the cost of the missing fuel plus a service charge. The fuel level is recorded on the rental agreement at pickup and drop off.

The Touch n Go card provided must hold a specific balance at pickup and drop off. A differing balance incurs charges at Agtran's rates, with no refund for excess balance. Acceptance of the vehicle implies agreement with this policy.

The renter is responsible for all toll fees, parking, speeding, and traffic violations incurred during the rental period. Agtran will charge the renter's payment method on file the administrative fee described in the Payment, Charges & Tax section per occurrence, plus the cost of the toll or fine, after the rental period ends. Failure to pay may result in additional penalties.

The renter is responsible for physical damage to the vehicle during the rental period, regardless of fault, subject to any optional waiver purchased under the Insurance, Damage Waiver & Liability section. Damage must be reported to Customer Service on return. Repair costs and administration fees vary by damage type.

• Minor issues (scratches, glass, bumper damage) incur fees set out in our price list.
• Major damage is assessed by an expert or independent repair shop if immobilisation is required.
• After the rental, Agtran provides documentation for discovered damage, including estimates and admin fees.
• The renter may dispute a charge by contacting Customer Service within 14 days. After that period, Agtran may invoice for repairs and fees.

Note: Agtran does not pursue renter claims or handle liability payments on the renter's behalf. Renters with alternative insurance settle payments directly and then claim from their own insurer.

• The renter is responsible for changing any flat tyre using the spare tyre, jack, and equipment provided.
• If the renter fails or declines to change the flat tyre, Agtran will change it and apply fees based on the distance from the rental branch.
• The renter is responsible for all tyre and wheel damage caused by road hazards during the rental period. Agtran provides the equipment for tyre changes but does not provide roadside assistance. An optional tyre damage waiver may reduce the renter's liability.

Agtran is not responsible for loss of or damage to personal items left in the vehicle at the end of the rental period. Left items are handled as follows:

• Valueless, fragile, dangerous, or perishable items are kept for 3 days, then disposed of.
• Important items are stored for 7 days, then handed to the police. If unclaimed, they are stored for one month.
• Prohibited items are handed to the police immediately.
• Other items are stored for one month, then discarded if unclaimed.

If the renter wishes any found item to be returned, shipping and handling fees apply. The renter agrees to indemnify Agtran for any liability regarding personal items left behind.

Agtran reserves the right to terminate rental agreements and repossess the vehicle without notice if the renter violates any term, operates the vehicle recklessly or unlawfully, or otherwise breaches the agreement. In such cases, law enforcement may be contacted to seize the vehicle and no refund will be given. The renter remains responsible for any outstanding balance, fees, or damages owed.

• To the extent permitted by law, Agtran is not liable for indirect or consequential loss, including loss of profit, business, or enjoyment, arising from the rental.
• Nothing in these terms limits liability that cannot be limited under Malaysian law.
• The renter agrees to indemnify Agtran against claims, losses, fines, and costs arising from the renter's use of the vehicle or breach of these terms.

Agtran is not liable for failure or delay in performing its obligations where caused by events beyond its reasonable control, including natural disasters, accidents, strikes, government action, or other force majeure events.

• If any provision of these terms is found to be invalid, the remaining provisions continue in effect.
• These terms, together with the rental agreement and price list, form the entire agreement between the renter and Agtran.
• Agtran may amend these terms from time to time. The version in force at the time of booking applies to that rental.

These terms are governed by the laws of Malaysia. The courts of Malaysia have exclusive jurisdiction over any dispute arising from or relating to the rental.
